Arbitration

Akinwunmi & Busari has extensive experience in dispute resolution. We have successfully facilitated the resolution of disputes through Arbitration and various known means of Alternative Dispute Resolution.  Our firm in advising clients strives to balance the advantages of rigorously conducted litigation with the benefits of a swift settlement of disputes by negotiation and more formal dispute resolution procedures. Akinwunmi & Busari has a well-organized and respected arbitration practice. The private nature of Arbitration and ADR will not permit a detailed report of previous Arbitration and ADR experience. It will be sufficient however to mention a few recent experiences. Our law firm has:

  • Acted as Mediator and/or Arbitrator in a number of disputes.
  • Acted as Mediator and/or Arbitrator in several loan/credit facilities involving banks and its customers. For instance, in a just concluded mediation between Trade Bank Plc and a corporate customer in respect of a dispute involving over N200 million.
  • Acted as Mediator and/or Arbitrator in various commercial transactions. For instance;
    • In an aviation dispute involving an indigenous Airline and another foreign Company for a claim of over US$1.3 million in respect of outstanding lease rentals over a Boeing 707 Aircraft.
    • In a dispute involving one of the first generation Universities located in Southern Nigeria.
    • In a dispute involving title to a Rubber plantation located in the South-South Nigeria and involving a State Government and a private company.
    • Participated in domestic and International arbitration as counsel to the parties at various stages and as an Arbitrator.

One of our partners, Mr. ‘Tunde Busari is a Chartered Arbitrator and a Fellow of the Chartered Institute of Arbitrators, United Kingdom. He is currently the Honourable Secretary of the Chartered Institute of Arbitrators, U.K, Nigerian Branch. He is also a member of the following bodies;

  1. Steering Committee of the Lagos Multi-door Court House (LMDC) for Alternative Dispute Resolution.
  2. Committee on Arbitration and ADR (Committee D) of the International Bar Association (IBA).
  3. Chartered Institute of Arbitrators U.K.
  4. The (LCIA) London Court of International Arbitration (Pan African Council).
  5. Arbitration Committee of the Lagos Chamber of Commerce and Industry (LCCI).
  6. Business Recovery and Insolvency Practitioners Association of Nigeria (BRIPAN).
  7. A listed Arbitrator with the Regional Centre for International Commercial Arbitration, Lagos, Nigeria.
  8. A listed Arbitrator on the Panel of Neutrals of the Lagos Multi-door Court-House.
  9. A member of the National Committee on the Reform and Harmonisation of Arbitration and ADR Law.
